View Full Version : 3 ordered to pay 02 + Orange (Dispute)

After a long drawn out dispute 3UK have been ordered to pay both O2 and Orange for calls terminated on their networks.

The dispute relates to 3 UK not wanting to pay a 'blended 2G/3G' termination rate by Orange and 02. Despite the fact that 3 UK have had much higher charges they objected to paying more arguing that they should pay 2G rates which have been regulated and capped for some time. 02 and orange argued that a higher proportion of calls were now terminating on their 3G networks therefore a blended charge should apply. 3 UK asked ofcom to resolve the issue and suggested they should decide the level of termination 02 and Orange should charge.

Ofcom refused to set charges and agreed that o2 and Orange had a right to some varience due to their increasing terminatiion of calls from H3G on their 3G networks. Ofcom ordered that all fees due to be paid to Orange and 02 should be settled on the day of publication of the consultation.
